Terms of Service
These Terms govern your use of Focii — including the web dashboard, Chrome browser extension, and Windows Companion application. Please read them carefully before using the service.
1. Acceptance of Terms
By creating an account, installing any component of the Focii platform, or otherwise accessing the service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
These Terms constitute a legally binding agreement between you and Samantha Manono, trading as Focii ("we", "us", or "our"), the operator of Focii.
2. What Focii Is
Focii is a parental monitoring and focus-session management platform. It consists of three components that work together:
- The Focii Web Dashboard — a Next.js web application where parents create accounts, manage student profiles, start and control focus sessions, review session analytics, approve or deny override requests, configure blocking rules, and manage subscriptions.
- The Focii Chrome Browser Extension — a Manifest V3 Chrome extension installed on the student's browser. During an active focus session it intercepts every navigation attempt, classifies the destination using a three-tier system (whitelist, cached domain intelligence, and AI semantic analysis), and enforces block or allow decisions in real time.
- The Focii Windows Companion Application — a desktop application installed on the student's Windows PC. It inventories installed applications, enforces app-blocking policies pushed from the parent dashboard during active sessions, and maintains a local policy cache for offline enforcement.
The service is intended solely for use by parents and guardians ("parents") to supervise their own children's or dependants' ("students") study activity. It is not a general-purpose content filter and is not designed or marketed for use in schools, enterprises, or other institutional settings without a separate written agreement.
3. Eligibility and Account Registration
To register a Focii account you must be at least 18 years of age and legally capable of entering into a binding contract in your jurisdiction. Focii accounts may only be created by parents or guardians. Students do not independently create or administer Focii accounts.
When you register you agree to provide accurate, complete, and current information including your email address. You are responsible for keeping your account credentials — including your password and optional account PIN — confidential and secure. You are responsible for all activity that occurs under your account.
You may not transfer your account to another person or allow others to use it without our prior written consent.
4. Parent Responsibilities
As the account holder you are solely responsible for:
- Obtaining any consents required by applicable law before installing the extension or Windows Companion on a device used by a student, and before collecting or reviewing session activity data
- Ensuring that your use of Focii complies with the laws of your jurisdiction, including but not limited to laws governing electronic monitoring, children's privacy, and parental oversight
- Creating and managing student profiles within your account, including configuring blocking rules, reviewing session data, and approving or denying override requests
- Physically installing the Chrome extension and Windows Companion on student devices and maintaining those installations
- Reviewing AI-generated session reports and analytics with your own judgement — automated outputs are supportive tools, not guaranteed conclusions
- Keeping your account credentials and PIN secure and not sharing them with students or third parties
We provide the tools. You are responsible for how you use them.
5. Student Profiles and Monitored Devices
Student profiles are sub-accounts created within the parent account. A student may log in to the Chrome extension using credentials created by the parent, but the student has no access to the dashboard, session configuration, blocking rules, or any other parent-level controls.
During an active focus session the Chrome extension running on the student's browser will:
- Intercept every URL navigation in the browser and classify it before allowing or blocking it
- Record the URL, page title, classification decision (ALLOWED / BLOCKED / AMBIGUOUS), AI-generated academic and distraction scores, confidence level, and decision latency for every page visited
- Intercept and classify search queries entered into Google, Bing, Yahoo, and DuckDuckGo
- Allow the student to submit override requests for blocked URLs, which are sent to the parent for real-time approval or denial via push notification
- Communicate with the Focii Windows Companion over Native Messaging (a local pipe, not a network connection) to synchronise session state and enforcement policies
The Windows Companion, when installed and paired, will additionally:
- Scan the device for installed applications (via the Windows registry and Start Menu) and sync that inventory to the parent dashboard so the parent can create app-blocking rules
- Block designated applications from launching during active focus sessions
- Poll for updated blocking policies every 30 seconds
- Maintain a local policy cache so blocking enforcement continues during brief internet outages
- Send a heartbeat to our servers every 60 seconds while running
6. AI-Powered Features
Focii uses artificial intelligence at several points in the service:
6.1 Real-Time Site Classification
When a student navigates to a URL that is not in the local whitelist or domain cache, the extension sends the URL and available page metadata (title, description, and for YouTube or Reddit: video or post content) to OpenAI's GPT-4o-mini model. The model returns an academic score, distraction score, category label, and reasoning string. This result is cached at the domain level for future use.
6.2 Session Reports and Weekly Digests
At the conclusion of a focus session, and in weekly digest emails, we generate an AI-written narrative summary for the parent. These summaries are produced by sending aggregated session statistics (counts, scores, domain names, blocked app names) to GPT-4o-mini — not raw URLs or page content.
6.3 Accuracy and Limitations
AI classification is provided to assist parental oversight, not to replace it. We do not guarantee that any classification, summary, or recommendation produced by AI features will be accurate, complete, or free from error. A site may be incorrectly blocked or incorrectly allowed. AI-generated session summaries may contain inaccuracies. You should use your own judgement when acting on AI-generated outputs.
Availability of AI features depends on OpenAI service uptime. If the OpenAI API is unavailable, Tier 3 classification falls back gracefully — sites that cannot be classified may default to the configured unknown-site policy you have set.
7. Subscriptions and Billing
7.1 Plans
Focii is offered on a tiered subscription basis. The family plan supports up to 1 student profile(s) and includes core focus-session and website-blocking features. The premium plan supports up to 2 student profile(s) and additionally unlocks the Windows Companion application locker, AI session reports, and weekly digest emails. Full feature details are listed on the pricing page.
7.2 Paddle — Merchant of Record
All subscription payments are processed by Paddle, who acts as the Merchant of Record for Focii. When you purchase a subscription, your billing relationship is with Paddle, not with us. Paddle collects and processes your payment information, handles tax obligations, and issues receipts. Your purchase is subject to Paddle's terms of service in addition to these Terms. We receive webhook notifications from Paddle confirming subscription status and renewal events, but we do not store or process your payment card details.
7.3 Trials and Renewals
Where a free trial is offered, access to premium features is granted for the trial period of 5 days without charge. At the end of the trial, your subscription will automatically renew at the applicable plan price unless you cancel before the trial expires. Renewal dates, pricing, and billing intervals are displayed at checkout and in your billing settings.
7.4 Cancellation
You may cancel your subscription at any time from your dashboard billing settings or by contacting Paddle directly. Cancellation takes effect at the end of your current billing period. You will retain access to premium features until that date. We do not provide partial refunds for unused time in a billing period unless required by applicable law.
7.5 Plan Changes
We may introduce new plans, adjust pricing, add features to or remove features from existing plans, or discontinue plans. We will give reasonable advance notice of any changes that materially affect your current subscription.
8. Acceptable Use
You agree not to use Focii to:
- Monitor any person who has not consented to being monitored, or for whom you do not have legal authority to act as parent or guardian
- Circumvent, reverse engineer, decompile, or tamper with any part of the platform including the Chrome extension, Windows Companion, dashboard, or our servers
- Attempt to gain unauthorised access to another user's account, student data, or our backend systems
- Interfere with the operation of the service or impose an unreasonable load on our infrastructure
- Use the service for any unlawful, abusive, fraudulent, or harmful purpose
- Resell, sublicense, or commercially redistribute access to Focii without our written permission
- Use session data or analytics to harass, intimidate, or unfairly punish a student beyond reasonable parental oversight
9. Third-Party Services and Dependencies
Focii depends on third-party services to function. While we select providers carefully, we are not responsible for their availability, performance, or changes to their terms. Key dependencies include:
- Supabase — database, authentication, and real-time infrastructure
- OpenAI — AI classification and report generation
- YouTube Data API (Google) — video metadata for classification of YouTube URLs
- Resend — transactional and digest email delivery
- Paddle — subscription billing and payment processing
- Cloudflare Turnstile — bot protection on authentication forms
- Vercel — dashboard hosting
- Chrome Web Store (Google) — extension distribution
Disruption to any of these services may temporarily affect the availability or accuracy of Focii features. We will not be liable for outages, data losses, or service degradation caused by third-party providers.
10. Intellectual Property
All software, designs, interfaces, branding, trademarks, and content comprising Focii — including the dashboard, Chrome extension, and Windows Companion — are the intellectual property of Samantha Manono, trading as Focii or our licensors and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the software components of Focii solely for the purposes described in these Terms. You may not copy, modify, distribute, create derivative works from, or commercially exploit any part of the service without our prior written consent.
You retain ownership of your account data. By using the service you grant us a limited licence to process, store, and transmit that data solely to operate the platform and provide the features described in these Terms.
11. Privacy and Data
Your use of Focii is subject to our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains in detail what data we collect from parents and from student devices, how it is processed and stored, which third parties receive it, and what rights you have over it.
Because Focii may collect browsing and application activity data from devices used by children, you are responsible for ensuring that your use of the service complies with applicable children's privacy laws in your jurisdiction — including but not limited to COPPA in the United States and the UK Children's Code. Our COPPA Compliance page describes how the platform is designed with this in mind.
12. Service Availability and Changes
We aim to operate Focii reliably, but we do not guarantee that the service will be available at all times, uninterrupted, or free from errors. The following may affect service availability:
- Scheduled or emergency maintenance
- Outages at Supabase, Vercel, OpenAI, or other infrastructure providers
- Chrome Web Store policy changes affecting the extension
- Network conditions on student devices
- Windows Companion connectivity issues on the student PC
We reserve the right to modify, improve, deprecate, or discontinue any feature or component of the service at any time. Where changes materially affect your use of the service we will provide reasonable advance notice.
13. Disclaimer of Warranties
To the fullest extent permitted by applicable law, Focii is provided "as is" and "as available" without warranties of any kind, whether express or implied. We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The service will be error-free, uninterrupted, or fully secure
- AI classification decisions will be accurate — sites may be incorrectly blocked or allowed
- The Windows Companion will block every application in every scenario, particularly after Windows updates or in configurations we have not tested
- Session reports or AI summaries will be factually accurate or complete
- The service will prevent all distracting content from reaching a student during a session
14. Limitation of Liability
To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of Focii, including but not limited to loss of data, loss of revenue, loss of goodwill, or damages arising from reliance on AI-generated outputs.
Our total aggregate liability for all claims relating to the service — regardless of the form of action — will not exceed the greater of: (a) the total amount you paid us in the twelve months preceding the claim, or (b) one hundred pounds sterling / one hundred US dollars (whichever currency applies to your account), or the minimum amount permitted by law where no payment was made.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless Samantha Manono, trading as Focii, its officers, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the service in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) any claim that your use of Focii to monitor a student was unlawful or in breach of that student's rights.
16. Termination
You may stop using Focii at any time and cancel your subscription via the dashboard billing settings. Uninstalling the Chrome extension and Windows Companion from student devices will stop all local monitoring immediately. Cancelling your account will delete your student profiles and associated session data in accordance with our Privacy Policy retention schedule.
We may suspend or terminate your access to the service without prior notice if we reasonably believe that you have: materially breached these Terms; used the service in a way that creates legal or reputational risk; failed to pay applicable fees; or engaged in fraudulent or abusive activity. Where feasible we will give you advance notice and an opportunity to remedy the breach before terminating access.
Upon termination, your licence to use all components of Focii is immediately revoked. Sections 10, 13, 14, 15, and 17 survive termination.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes we will update the effective date at the top of this page and, where appropriate, notify you by email or via an in-dashboard notice. Continued use of the service after updated Terms take effect constitutes your acceptance of those Terms.
18. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of Republic Of South Africa, without regard to its conflict of law provisions.
Any disputes arising out of or in connection with these Terms or your use of Focii will be subject to the exclusive jurisdiction of the courts of Republic Of South Africa. If you are a consumer in a jurisdiction that grants you the right to bring claims in local courts, this clause does not override those rights.
